Written by Brian Mwenda who has been trending for some time now for faking to be a lawyer has finally been set free after a court battle. He was granted a sh.200,000 cash bail by Chief Magistrate Lucas Onyina.
Chief Magistrate Lucas Onyina stated in his ruling that he had given consideration to all the hearings from the prosecution and from the defence and came up with a ruling based on the evidence.
He said that he agreed with the submissions that were made by the defence team and agreed that there were indeed no compelling reasons to deny Brian Mwenda bail. His ruling stated that, “I therefore release the accused person on a bond pf sh.300,000 or a cash bail of sh.200,000 with one contact person.
Brian Mwenda was represented by top lawyers, John Khaminwa and Danstan Omari. The lawyers termed the allegations by the prosecution team that he would abscond court proceedings as a false narrative and tabled their defence that Brian Mwenda who is their client has no intentions of living the country.
Brian Mwenda accused the Law Society of Kenya of having double standards and quoted that there are very many cases of impersonation that the society has never dealt with the way they are dealing with his case.
He wrote in his affidavit that the Law Society of Kenya should tell the court and members of the public what motivated them to present him as an advocate and also tell the public if they got some financial benefit from that and once that stopped, they decided to take the route of revenge by exposing him.
Brian Mwenda also said that the President of the Law Society of Kenya Mr. Theuri had not in one occasion but many occasions bailed him and his friends whenever they found themselves in the wrong side of law for drinking related cases.
He also added that it might be a political move because it is a thigh political season for the Law Society of Kenya and therefore that is why he is being targeted.
