Big Blow to Gachagua as High Court Disallows Recusal of Judges Hearing his Impeachment Petitions

The impeached Deputy President, honorable Rigathi Gachagua has yet again gotten another big blow, this is after the High Court disallowed the recusal of the judges hearing his impeachment petitions.

Justices Eric Ogola, Anthony Mrima and Freda Mugambi rejected the application to recuse themselves from hearing the impeachment case against the embattled Deputy President, honorable Rigathi Gachagua.

They however allowed the embattled Deputy President and his legal team, to file a petition against their ruling. This comes after honorable Rigathi Gachagua had stated that, wants the judges who were constituted to hear his impeachment case to be barred from hearing his case.

He stated in his submissions that, Justice Antony Mrima is a close associate of Professor Kithure Kindiki who was approved by the National Assembly to take over from honorable Rigathi Gachagua.

He also stated that, Lady Justice Freda Mugambi was Professor Kithure Kindiki’s Master of Law Student at Moi University.

Advocate Ndegwa Njiru who is also representing the impeached Deputy President wanted the court to expunge the two paragraphs seeking the three judge bench to recuse itself from the case. This application was however rejected and declined by the judges.

The embattled Deputy President is still seeking for justice in the corridors of justice because he still affirms that he is being politically lynched. He also still holds the fact that, he was denied the opportunity for a fair hearing, after the National Senate proceeded with the impeachment motion against him even without hearing his side of the story, bearing in mind that he was the only witness in his defence.

The Senators voted against the embattled Deputy President in 5 accounts out of the 11 accounts that he was accused of. President William Ruto then went ahead and nominated Professor Kithure Kindiki as the Deputy President and he was approved by the National Assembly. This is part of what has led to the numerous petitions on the impeachment of honorable Rigathi Gachagua.
