Big Blow to Gachagua as the Court Clears the Swearing in of Kindiki as the new DP

The embattled Deputy President, honorable Rigathi Gachagua has been dealt a major blow by the High Court. This is after the three judge bench consisting of Justices Eric Ogolla, Anthony Mrima and Fridah Mugambi disallowed the applications for the Conservatory order.

Justice Anthony Mrima said that, they are convinced beyond reasonable doubt that, the current Constitutional framework does not envision any scenario in which the office of the Deputy President would remain vacant except during a brief period when required to fill a vacancy.

In his ruling, he stated that the public interest demands that the Higher office of the Deputy President should not remain vacant but should be filled.

Justice Eric Ogolla said that, the applications for the conservatory orders were disallowed and set aside. The Conservatory Orders were issued on 18th October 2024 at the Kerugoya High Court.

The former Attorney General who was the lawyer of the Attorney General urged the three judge bench to lift the Conservatory Orders so that it can pave way for the swearing in of a new Deputy President. He also stated that, the office of the Deputy President was left vacant and the Conservatory Orders had also been overtaken by events.

The Senator of Kisumu County, honorable Tom Ojienda also said that, the conservatory orders have derailed operations of the government. He also said that, the interest of the Nation and the public should be put first instead of just focusing on the interest of an individual.

Honorable Rigathi Gachagua was impeached by the National Assembly and then later the impeachment was taken to the National Senate where he was also impeached. Professor Kithure Kindiki was then appointed by the President and he was later unanimously approved by the National Assembly.

The ruling that has been made by the High Court now paves way for the swearing in of the former Cabinet Secretary for Interior.
